MOWA Terms of Service

Mowa is a social wishlist platform that allows users to:

• Create and manage wishlists
• Share wishlists with friends, family, and followers
• Friend and interact with other users
• Discover wishlist ideas, products, and trends
• Coordinate gifting and contributions toward gifts
• View and interact with external product links and services
• Link external payment services for off-platform transactions

Mowa is a social coordination and discovery platform. It is not a payment processor, financial institution, or escrow service.

You must be at least 13 years of age to use the Services.

By using Mowa, you represent and warrant that:

• You are at least 13 years old
• If you are under the age of majority in your jurisdiction, you have permission from a parent or legal guardian to use the Services
• You are legally able to enter into these Terms
• All information you provide is accurate and complete

We do not knowingly permit children under 13 to use the Services.

To use certain features, you may be required to create an account.

You agree to:

• Provide accurate and current information
• Maintain the security of your account
• Not share your login credentials
• Accept responsibility for all activity under your account

We reserve the right to reclaim usernames or suspend accounts at our discretion.

Users may create, upload, or share content including:

• Wishlists
• Product links and descriptions
• Images and media
• Messages and comments
• Profile information

You retain ownership of your content.

By submitting content, you grant Amiti Group a worldwide, non-exclusive, royalty-free license to:

• Host, store, and display your content
• Operate and improve the Services
• Use content for system functionality such as ranking, discovery, and recommendations

You are responsible for ensuring your content does not:

• Violate any laws or regulations
• Infringe intellectual property or privacy rights
• Contain false, misleading, or fraudulent information
• Include personal data of others without permission

Mowa allows social interaction around wishlists.

You understand that:

• Wishlist visibility is controlled by user settings (public, private, or shared)
• Users may view, follow, or interact with wishlists where permitted
• Expressions of gifting intent are not legally binding
• Mowa does not guarantee that any wishlist item will be purchased or fulfilled
• Users are solely responsible for their interactions with other users
• We are not responsible for disputes between users

Mowa does not:

• Process payments
• Hold or transfer funds
• Act as an escrow or trustee
• Provide money transmission services
• Guarantee financial transactions

Any financial transaction between users occurs solely off-platform through third-party services or retailers.

You acknowledge and agree that:

• Mowa is not responsible for payment failures, fraud, or disputes
• Any external transaction is solely between you and the third party
• Use of third-party payment services is governed by their own terms

The Services may contain links to third-party websites, retailers, or services.

We do not:

• Endorse third-party services
• Control third-party content or practices
• Guarantee accuracy, safety, or availability of third-party services

Your use of third-party services is at your own risk.

You agree not to:

• Violate any applicable law or regulation
• Use the Services for fraudulent or deceptive purposes
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Upload malicious code or spam
• Scrape, crawl, or extract data without permission
• Attempt to reverse engineer or interfere with the Services
• Use the Services to solicit money fraudulently or misleadingly

We reserve the right to investigate and take action against violations.

We may, but are not obligated to, monitor, review, or moderate content.

We reserve the right to:

• Remove or restrict content
• Suspend or terminate accounts
• Limit visibility of content
• Use automated systems to detect abuse, fraud, or harmful activity

We do not guarantee proactive moderation of all content.

Mowa permits users aged 13–17 under the following protections:

You grant Amiti Group the right to:

• Use content to operate and improve the Services
• Generate analytics, rankings, and recommendations
• Display content based on user settings

We may use aggregated or de-identified data for platform improvement.

You acknowledge that Mowa may evolve and introduce features including:

• Product recommendation systems
• Affiliate commerce and retailer integrations
• Sponsored content and listings
• Personalized discovery feeds
• Machine-learning or AI-based recommendations
• Advertising features

Any new features will remain subject to these Terms unless otherwise stated.

All rights, title, and interest in the Services (excluding user content) are owned by Amiti Group, including:

• Software
• Design
• Branding
• Logos
• Features and functionality

You may not copy, modify, or distribute any part of the Services without permission.

We may suspend or terminate access to the Services at any time if:

• You violate these Terms
• We are required to do so by law
• We discontinue the Services or a feature

You may stop using the Services at any time.

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

We do not guarantee:

• That the Services will be uninterrupted or error-free
• That any wishlist item will be fulfilled
• Reliability of third-party services or links

To the maximum extent permitted by law, Amiti Group is not liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or goodwill
• User disputes or interactions
• Third-party transactions or services

You agree to indemnify and hold harmless Amiti Group from claims arising from:

• Your use of the Services
• Your content
• Your violation of these Terms

Any disputes will be resolved through binding arbitration under the American Arbitration Association (AAA) rules in Georgia, United States.

You waive:

• Right to a jury trial
• Right to participate in class actions or class arbitration

These Terms are governed by the laws of the State of Georgia, United States.

We may update these Terms from time to time. Material changes will be communicated via:

• Email
• In-app notification
• Website notice

Continued use of the Services constitutes acceptance of updated Terms.
